These Terms and Conditions govern your use of the Brill mobile application. By downloading, installing, or using Brill, you agree to these terms.

1. Use of Our App

  • Age Requirement: You must be at least 13 years old to use Brill. If you are under 18, you represent that you have parental or guardian consent to use the app.

  • Acceptable Use: You agree to use Brill only for lawful purposes and in accordance with these Terms. You agree not to:

  • Reverse engineer, decompile, or disassemble the app

  • Attempt to gain unauthorized access to the app or its systems

  • Use the app in any way that could damage, disable, or impair the app or interfere with other users' access

  • Remove or alter any copyright, trademark, or other proprietary notices

  • Modifications: We reserve the right to modify, suspend, or discontinue any part of the app at any time without prior notice.

2. Subscriptions & In-App Purchases

  • Pro Subscription: Brill offers a Pro subscription that unlocks additional features, including:

  • Access to all words beyond the first 365 words

  • Customizable word frequency settings

  • Advanced widget interaction features

  • Subscription Terms:

  • Subscriptions are managed through Apple's App Store and are subject to Apple's terms and conditions

  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period

  • You can manage or cancel your subscription through your Apple ID account settings

  • Pricing: Subscription prices are displayed in the app and may vary by region. We reserve the right to change subscription prices at any time, with changes applying to subsequent subscription periods.

  • Availability: We reserve the right to refuse or cancel any subscription at our discretion.

3. Payments & Billing

  • Payment Processing: All payments are processed through Apple's App Store. We do not collect or store your payment information.

  • Billing: You agree to provide accurate billing information through your Apple ID account. You are responsible for maintaining the security of your Apple ID account.

  • Payment Disputes: Any payment disputes must be resolved through Apple's customer support or your payment provider. We reserve the right to suspend or cancel subscriptions in cases of payment disputes or fraudulent activity.

4. Refunds & Cancellations

  • Refund Policy: Refund requests for subscriptions must be submitted through Apple's App Store refund process. Apple's standard refund policy applies.

  • Cancellation: You may cancel your subscription at any time through your Apple ID account settings. Cancellation will take effect at the end of your current billing period, and you will retain access to Pro features until that time.

  • No Refunds for Partial Periods: We do not provide refunds for partial subscription periods, except as required by law or as determined by Apple.

5. Intellectual Property

  • Our Content: All content in Brill, including but not limited to:

  • Word lists, translations, and language data

  • App design, graphics, logos, and user interface

  • Software code and functionality

  • Documentation and materials

is the property of Brill or its licensors and is protected by copyright, trademark, and other intellectual property laws.

  • User-Generated Content: Any custom words or content you create within the app remain your property. By using the app, you grant us a license to store and display this content solely for the purpose of providing the app's functionality.

  • Restrictions: You may not:

  • Copy, reproduce, distribute, or create derivative works from the app's content without written permission

  • Use our trademarks, logos, or branding without permission

  • Extract or scrape word lists or other content for use outside the app

6. Limitation of Liability

  • No Warranty: Brill is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

  • Limitation of Damages: To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of data or content

  • Loss of profits or business opportunities

  • Service interruptions or errors

  • Any damages arising from your use or inability to use the app

  • Maximum Liability: Our total liability to you for any claims arising from your use of the app shall not exceed the amount you paid for your subscription in the 12 months preceding the claim, or $50, whichever is greater.

7. Privacy Policy

  • Data Collection: Your use of Brill is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using the app, you consent to the collection and use of information as described in our Privacy Policy.

  • Security: While we implement security measures to protect your data, we cannot guarantee absolute security. You use the app at your own risk.

8. Third-Party Services

  • Apple App Store: Brill is distributed through the Apple App Store and is subject to Apple's terms and conditions. Your use of the App Store is governed by Apple's terms.

  • Service Providers: We use third-party services including:

  • Firebase (Google): For analytics and app performance monitoring

  • RevenueCat: For subscription management

  • Apple: For payment processing and app distribution

These services have their own terms and privacy policies that apply to your use of their services.

9. Termination

  • By You: You may stop using Brill at any time by deleting the app from your device.

  • By Us: We reserve the right to suspend or terminate your access to the app at any time, with or without cause or notice, for any reason including violation of these Terms.

  • Effect of Termination: Upon termination, your right to use the app will immediately cease. If your subscription is terminated, you will lose access to Pro features.

10. Changes to Terms

  • Updates: We reserve the right to modify these Terms and Conditions at any time. We will notify you of material changes by:

  • Posting the updated Terms in the app or on our website

  • Updating the "Last Updated" date

  • Providing notice through the app when possible

  • Acceptance: Your continued use of Brill after changes are posted constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the app.

11. Governing Law & Disputes

  • Governing Law: These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions.
